IMPORTANT OWNERSHIP AND LICENSING NOTICE

ThriveX Fitness App is:

OWNED BY: Negus Holdings LLC Series – ATF – Series 2 (“Owner”)

LICENSED TO: Negus Holdings LLC Series – TM – Series 3 (“Operator”) solely for operational and payment processing purposes

INTELLECTUAL PROPERTY: The Operator holds NO ownership rights in the ThriveX source code, algorithms, software, trademarks, logos, or user data.

1. INFORMATION WE COLLECT

1.1 Account Information

When you create an account, we collect: Email address and password (encrypted), Full name, Profile photo (optional), Account creation and last login dates

1.2 Health and Fitness Data

Physical Profile: Age, gender, height, weight, body measurements, fitness level, fitness goals, medical conditions (if provided)

Workout Data: Exercise names, sets, reps, weights, workout duration, calories burned estimates, personal records, custom routines, session timestamps

Nutrition Information: Food items consumed, calorie intake, macronutrient breakdown, micronutrients, water intake, food preferences, allergies, dietary restrictions, food photos, barcode scans, recipes and meal plans

Progress Tracking: Body weight trends, progress photos (encrypted), measurement history, fitness achievements, activity streaks

1.3 Apple Health (HealthKit) Integration

Optional Integration: ThriveX Fitness can integrate with Apple Health to sync your fitness and health data.

Data We Read from Apple Health (with your permission):

Heart rate and resting heart rate
Heart rate variability (HRV)
Steps and distance walked/run
Active energy burned
Workout sessions
Sleep analysis
Blood oxygen levels

Data We Write to Apple Health (with your permission):

Workout sessions logged in ThriveX
Active energy burned during workouts
Exercise minutes and distance

Your Control: You can enable or disable Apple Health integration at any time in the app settings. We only access HealthKit data that you explicitly authorize. HealthKit data is processed locally on your device and is not shared with third parties. This data remains in your Apple Health app and is not transmitted to our servers except for display purposes within ThriveX.

Important: Apple Health integration is entirely optional. ThriveX functions fully without Apple Health access.

Provide personalized workout and nutrition plans

Generate AI-powered recommendations
Calculate calorie and macro targets
Enable social features and community interaction

2.2 Service Improvement

Analyze usage patterns to improve features
Optimize app performance and user experience
Develop new features based on user needs
Troubleshoot technical issues

3. DATA SHARING AND THIRD PARTIES

⚠️ OUR COMMITMENT

WE NEVER SELL YOUR PERSONAL HEALTH DATA. Your fitness and nutrition information is never sold to insurance companies, employers, advertisers, data brokers, or marketing companies.

3.1 Service Providers We Use

Database & Authentication: Supabase – Secure cloud storage and user authentication. All data encrypted at rest and in transit.

AI Services: Anthropic Claude – Powers AI workout generation and meal planning. Only necessary data sent for processing. No permanent storage by AI provider.

Payment Processing: Stripe – Handles all payment transactions. Managed by Negus Holdings LLC Series – TM – Series 3. PCI-DSS compliant.

4. DATA SECURITY

4.1 Security Measures

Technical Safeguards:

AES-256 encryption for stored data
TLS 1.3 encryption for data transmission
Secure password hashing (bcrypt)
Regular security audits
Multi-factor authentication support
Biometric login options (Face ID, fingerprint)

4.2 Data Retention

Active Accounts: Data retained while your account is active. Historical data maintained for trend analysis.

Inactive Accounts: Reminder sent after 12 months of inactivity. Data archived after 24 months. Complete deletion after 36 months.

Account Deletion: Immediate removal from active systems. Complete purge within 30 days. Backup deletion within 90 days.

5. YOUR RIGHTS AND CONTROLS

Download workout and nutrition history
Access detailed activity logs

5.2 Control Your Data

Edit or update personal information
Delete specific workouts, meals, or records
Adjust privacy settings by category

5.3 Delete Your Data

You can request partial deletion (specific timeframes) or complete account deletion.

6. SPECIAL CONSIDERATIONS

6.1 Minors

Users under 13: Not permitted

Ages 13-17: Parental consent required prior to using app

6.2 Health Disclaimer

IMPORTANT: ThriveX is not a medical device or healthcare provider. Our recommendations are not medical advice. Consult healthcare providers before starting new fitness programs. We are not liable for injuries or health issues.

6.3 International Users

Primary servers located in United States. Data transferred to US servers with adequate safeguards. We comply with GDPR (EU users), UK Data Protection laws, PIPEDA (Canadian users), and Privacy Act 1988 (Australian users).

7. CALIFORNIA PRIVACY RIGHTS (CCPA)

Rights for California Residents:

Right to Know: Categories of personal information collected and sources
Right to Delete: Request deletion of personal information
Right to Opt-Out: Opt-out of data sharing (we don’t sell data)
Right to Non-Discrimination: Equal service regardless of privacy choices

8. CHILDREN’S PRIVACY

We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with personal information, please contact us immediately at support@thrivexdna.com and we will delete such information.

9. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy to reflect new features, comply with legal requirements, improve clarity, or address privacy concerns.

Notification of Changes: Email notification for material changes, in-app notification for all updates, 30-day notice before significant changes, option to export data before changes apply.
